Terms of Service

These terms govern your use of GitMend's AI-powered website security scanning service. Please read them carefully.
1. Agreement
These Terms of Service ("Terms") govern your access to and use of GitMend (the "Service"), an AI-powered security scanning product provided by GitMend. By creating an account or using the Service, you agree to be bound by these Terms.
2. The Service
GitMend runs automated AI agents that browse websites and web applications and produce reports describing potential bugs, security issues, and other findings. Scan reports are the product of automated analysis and do not constitute a professional security audit or certification. You are responsible for reviewing and validating any findings before acting on them.
3. Ownership attestation and acceptable use
You may only scan websites and applications that you own or that you are explicitly authorized to test. When you create or edit a project you attest to that ownership or authorization.
You agree not to use the Service to scan systems without permission, to attack, disrupt, or probe third-party infrastructure, or to violate any applicable law. We may suspend or terminate accounts that breach these rules.
4. Paid subscriptions and billing
The Service offers paid subscription plans processed by Stripe. Subscriptions renew automatically for the stated period until cancelled. Prices are shown on the pricing page and may change with notice; changes do not affect the remainder of a paid period.
You may cancel at any time through the manage-subscription flow; access continues until the end of the paid period. Except where required by law, payments already made are non-refundable.
5. Your content and data
You retain ownership of the project URLs, scan results, screenshots of scanned sites, and reports generated for your account ("Your Data"). You grant us a limited license to process Your Data solely to operate the Service, including having our scanning agents access the sites you designate.
You may delete projects and their scans at any time; deletion removes the associated reports from the Service.
6. Intellectual property
The Service, including its software, design, and documentation, is owned by GitMend and its licensors and is protected by intellectual property laws. These Terms grant you no rights in the Service other than the limited right to use it.
7. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that scans will identify every vulnerability or that the Service will be uninterrupted or error-free.
8. Limitation of liability
To the maximum extent permitted by law, GitMend shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our aggregate liability under these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms, fail to pay applicable fees, or create risk or legal exposure for us or others.
10. Changes and contact
We may update these Terms from time to time; material changes will be reflected in the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
